    Judge Orders HIV Positive Man to Compensate Defilement Victim

    Lady Justice Elizabeth Nahamya on Friday ordered an HIV positive man to pay UGX 2 Million to the family of the girl he defiled four years ago.

    The suspect was convicted as charged.

    Court heard that in October 2010, Mr Geoffrey Komakech, 26, a resident of Gudu village, Palenga parish in Gulu district defiled a 17-year-old girl.

    The two were engaged in love relationship which blossomed into the girl getting a pregnancy.

    During a medical checkup conducted on the girl on the order of the school authorities where the defiled girl was a Senior 3 student, it was discovered that the girl was pregnant.

    The matter was later reported to police leading to the arrest of the 26-year-old who was by then only 22 years old.

    Appearing before Lady Justice Nahamya, Komakech pleaded guilty to the charge leading to his conviction.

    While passing her judgment on Friday, Justice Nahamya noted that Komakech has been remorseful throughout the trial.

    The Judge also considered the fact that on three different occasions, the HIV tests carried on the defiled girl turned negative despite having sexual intercourse with Komakech whose HIV sero status results show that he is carrying the deadly virus.

    However Lady Justice Nahamya ordered that Komakech compensate his victim UGX 2 Million after the convict entered into negotiation with the family of the defilement survivors.

    Justice Nahamya explained that, “Under law, it is acceptable to award a defilement victim but warned Komakech not to get anywhere near the girl.”

    However she said Komakech can visit his two and half year old son.

    Court wants that the payment be completed by 27th of July this year as a condition of releasing him from Gulu Central Prison.

    The uncle of Komakech, Mr Alex Okwera agreed to pay UGX 800,000 by 25th of May this year and apologised to the girl and her family members.
