A 45 year old man has been charged at the Gulu High Court for allegedly having sex with an underage boy.

Maracelo Ojok, a farmer from Keto village, Lakwana Sub County in Omoro County appeared before Lady Justice Margret Mutonyi on Monday to answer a charge of aggravated defilement contrary to section 129 (3) (4) (a) of the penal code act.

It is alleged that on the night of November 1, 2013 at Keto village, Ojok sexually assaulted the boy. Prosecution led by William Bayo told court that on that fateful night, Ojok had sex with the victim when he (Ojok) visited the boys’ home. According to prosecution Ojok and the boy shared the same sleeping mat.

In his defence Ojok said he was drunk on the night in which he is alleged to have committed the offence and so, he said, he could not remember anything.

Ojok said he only learned about the incident the following morning after the elder brother of the boy accused him of having an anal sex with the boy believed to be a juvenile.

The suspect pleaded not guilty to the offence.

Lady Justice Mutonyi remanded him to Gulu Central Government Prisons until March 3, 2016 when the case will come up for hearing.

So far two assessors have been appointed by the Gulu resident High Court to assist court with advice.

Aggravated defilement is a capital offence and on conviction one can be sentenced to life in prison.
